For purposes of rule providing that findings of trial court shall not be set aside unless "clearly erroneous," refers to findings when based upon substantial error in proceedings or misapplication of law, Kauk v. Anderson, C.C.A.N.D., 137 F.2d 331, 333; or when unsupported by substantial evidence, or contrary to clear weight of evidence or induced by erroneous view of the law. Smith v. Porter, C.C.A.Ark., 143 F.2d 292, 294.
As a basis for appellate review, a finding is "clearly erroneous" when, although there is evidence to support it, the reviewing court on entire evidence is left with definite and firm conviction that a mistake has been committed. United States v. United States Gypsum, 333 U.S. 364, 395, 68 S.Ct. 525, 542.
